Terms of Use

1. ACCEPTANCE OF TERMS

1.1 This Agreement governs your use of this web site and its associated services (the "Web Service"), including interactive chat and forum discussion areas (the "Interactive Areas"), which are owned and operated by Space Technologies and Education Private Limited (STEPL), and its subsidiaries, affiliates, divisions and related companies.  By accessing this Site, you agree to the Terms of Use.
1.2 STEPL reserves the right to change the Terms of Use from time to time at its sole discretion. Your use of the Site will be subject to the most current version of the Terms of Use posted on the Site at the time of such use. In addition, when using particular Services or Materials on this Site, you shall be subject to any posted guidelines or rules applicable to such Services or Materials that may contain terms and conditions in addition to those in the Terms of Use. All such guidelines or rules are hereby incorporated by reference into the Terms of Use. If you breach any of the Terms of Use, your authorization to use this Site automatically terminates and you must immediately destroy any Materials downloaded or printed from the Site. If at any time the terms and conditions of this Agreement are no longer acceptable to you, you should immediately cease use of the Web Service and the Interactive Areas.

I /We hereby Agree that:

  • I/We have read the brochure/ pamphlets/ website/ registration form details, noted the club details, fees and agree to abide by the Rules, terms of registration form, etc. as formed by STEPL.
  • I/We transfer to Space Technologies and Education Pvt. Ltd. (the company) the copyright of photographs of me/ our child/ dependent or of any artwork/ painting/ model or text produced by me/ our child/ dependent while at any program/ activity organized by the company.
  • I am aware that the registration fee paid is non-transferable and non-refundable.
  • I/ We indemnify that the Astronomy Club, Company, S.P.A.C.E., its management, teachers, educators, staff and associated persons/ entities cannot be held responsible or liable for any accident, mishap or injury that may occur to me/ our child/ dependents or any member of my family in or around the premises of the organisation or any venue used by the company whether during or after the program/ activity hours, and/or while using the transport (whether arranged by me/ us or rented/ owned by the company) and/or while participating in any function/ excursions.
  • I/ We agree that Astronomy Club, the company, its management, teachers, staff & associated persons/ entities shall not be under any liability whatsoever under any law including the Consumer Protection Act, 1986.

 

2. Use of Content

2.1 The entire contents of this website, including product names, images, photography, text, logos, product names, design, titles and words or phrases and audio/video clips are the property of STEPL or its members and may be protected by copyright and other restrictions as well(trademark and other proprietary rights). Copyrights and other proprietary rights in the content on this website may also be owned by individuals and entities other than STEPL. With the exception of personal, non commercial use by our users, we prohibit the copying or reproduce any of the content of this website. Users of the Web Service wanting to use the content for commercial use must obtain prior express written permission of STEPL.

We will remove required videos, music, photographs or other content you upload onto the STEPL by law if we learn that it infringes someone else’s copyright. If you believe that we have mistakenly taken down content you uploaded that you own or have permission to upload, you can also let us know that. Finally, if you upload infringing content repeatedly, we will terminate your account and you could face criminal and civil penalties. Kindly respect other people’s copyrights.

2.2 You may not modify, publish, transmit, transfer or sell, reproduce, create derivative works from, distribute, perform, display, or in any way exploit any of the content, in whole or in part, except as otherwise expressly permitted in this Agreement. Content consisting of downloadable software may not be reverse-engineered unless specifically authorized by the owner of the software's patent and or copyright. You assume all right and responsibility for determining whether any content is in the public domain. You grant to STEPL the right to edit, copy, publish, distribute, translate and otherwise use in any medium and for any purpose any content that you place on the Web Service without compensation to you. You represent and warrant that you are authorized to grant all rights set forth in the preceding sentence.

2.3 The software and accompanying documentation that are made available to download from this Site are the copyrighted work of STEPL and/or its suppliers. Use of the software is governed by the terms of the end user license agreement that may accompany or be included with such software. You will not be able to download or install any software that is accompanied by or includes an end user license agreement unless you agree to the terms of such end user license agreement. If you do not agree to such terms, you will not be able to use the software. You may not decompile, reverse engineer or otherwise attempt to discover the source code of the software available on the Site


3. Rules of Conduct

3.1 You shall not post on the Web Service any content which (a) is libelous, defamatory, obscene, pornographic, abusive, harassing or threatening; (b) contains viruses or other contaminating or destructive features; (c) violates the rights of others, such as content which infringes any copyright, trademark, patent, trade secret or violates any right of privacy or publicity; (d) Use these services for surveys, contests, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise) ; or (e) otherwise violates any applicable law or reputation. You may not post on the Web Service any links to any external Internet sites that are obscene or pornographic. You shall not use the Web Service for any commercial purpose not expressly approved by STEPL, nor shall you distribute any advertising or solicitation of funds or goods and services or solicit users to join competitive online services.  You must not restrict or inhibit any other user from using and enjoying these Services.

3.2 If any of the Services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You will also  be provided a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You must agree to notify STEPL immediately of any unauthorized use of your account or any other breach of security. STEPL will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by STEPL or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.

 

4. Managing Content.

STEPL does not and cannot review the content posted by users on the Web Service and is not responsible for such content. However, STEPL reserves the right to delete, move or edit any content (including content posted in any Interactive Area) that it may determine, in its sole discretion, violates or may violate this Agreement or is otherwise unacceptable. You shall remain solely responsible for all content posted by you. STEPL shall have the right but not the obligation, to correct any errors or omissions in any content, as it may determine in its sole discretion.

 

5. No Endorsement.

5.1 STEPL does not represent or endorse the accuracy or reliability of any content posted on any Interactive Area and you acknowledge that any reliance upon such content shall be at your sole risk. Any content placed on any Interactive Area by users are the views of the user posting the statement, and do not represent the views of STEPL or its advertisers or sponsors.
5.2 The Web Service may contain links to sites on the Internet, which are owned and operated by third parties (the "External Sites"). The linked sites are not under the control of STEPL AND STEPL is not responsible for the contents of any linked site or any link contained in a linked site, OR any changes or updates to such sites. STEPL is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by the STEPL site.
This Site can be accessed from other countries around the world and may contain references to STEPL products, services, and programs that have not been announced in your country. These references do not imply that STEPL intends to announce or make such products, services or programs available in your country.

 

6. Termination of Service.

STEPL reserves the right, in its sole discretion, to restrict, suspend or terminate your access to all or any part of the Web Service, including the Interactive Areas, at any time for any reason without prior notice or liability. STEPL may change, suspend or discontinue all or any aspect of the Web Service at any time, including the availability of any feature, database, or Content (including the Interactive Areas), without prior notice or liability.

 

7. Indemnity.

You agree to indemnify and hold STEPL , and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post to or transmit through the Site, your use of the Site, your connection to the Site, your violation of the Terms of Use, or your violation of any rights of another person or entity  or any alleged use of the service under your user name by any person, whether or not authorized by you.

9. WARRANTIES AND DISCLAIMERS

EXCEPT AS EXPRESSLY PROVIDED OTHERWISE IN A WRITTEN AGREEMENT BETWEEN YOU AND STEPL , ALL MATERIALS AND SERVICES ON THIS SITE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THE WARRANTY OF NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, STEPL MAKES NO WARRANTY THAT

  • THE SERVICES AND MATERIALS WILL MEET YOUR REQUIREMENTS,
  • THE SERVICES AND MATERIALS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE,
  • THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR MATERIALS WILL BE EFFECTIVE, ACCURATE OR RELIABLE,
  • THE QUALITY OF ANY PRODUCTS, SERVICES, OR INFORMATION PURCHASED OR OBTAINED BY YOU FROM THE SITE WILL MEET YOUR EXPECTATIONS, AND
  • ANY ERRORS IN THE SOFTWARE OBTAINED FROM THE SITE WILL BE CORRECTED.. TO THE EXTENT PERMISSIBLE, ANY IMPLIED WARRANTIES ARE LIMITED TO NINETY (90) DAYS.

    THIS SITE COULD INCLUDE TECHNICAL OR OTHER MISTAKES, INACCURACIES OR TYPOGRAPHICAL ERRORS. STEPL MAY MAKE CHANGES TO THE MATERIALS AND SERVICES AT THIS SITE, INCLUDING THE PRICES AND DESCRIPTIONS OF ANY PRODUCTS LISTED HEREIN, AT ANY TIME WITHOUT NOTICE. THE MATERIALS OR SERVICES AT THIS SITE MAY BE OUT OF DATE, AND STEPL MAKES NO COMMITMENT TO UPDATE SUCH MATERIALS OR SERVICES.
    STEPL ASSUMES NO RESPONSIBILITY FOR ERRORS OR OMISSIONS IN THE INFORMATION, DOCUMENTS, SOFTWARE, MATERIALS AND/OR SERVICES WHICH ARE REFERENCED BY OR LINKED TO THIS SITE. SOME JURISDICTIONS PROHIBIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM STEPL OR THROUGH OR FROM THE SITE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS OF USE.

 

10.CONFIDENTIAL INFORMATION; PRIVACY

Please note that, with the exception of credit card numbers, STEPL does not want to receive confidential or proprietary information from you through our Site. Any non-personal information or material sent to STEPL will be deemed NOT to be confidential. By sending STEPL any non-personal information or material, you grant STEPL an unrestricted, irrevocable license to use, reproduce, display, perform, modify, transmit and distribute those materials or information, and you also agree that STEPL is free to use any ideas, concepts, know-how or techniques that you send us for any purpose. However, we will not release your name or otherwise publicize the fact that you submitted materials or other information to us unless:
(a) you grant us permission to doso;
(b) we first notify you that the materials or other information you submit to a particular part of the Site will be published or otherwise used with your name on it; or
(c) we are required to do so by law.

 

11. TRADEMARK INFORMATION

The trademarks, logos and service marks ("Marks") displayed on this Site are the property of STEPL or other third parties. You are not permitted to use the Marks without the prior written consent of STEPL or such third party which may own the Marks. STEPL and the STEPL logo are trademarks of STEPL.
